Bananas at Large Equipment Rental PolicyName of Customer: ___________________________ Order: __________________Phone Number: ___________________________ Date: __________________PICKUP & RETURN: Pickups are after 12 noon and returns are due back before 11am on the due day. If unable to makepick up or return times, other arrangements must be made with a Bananas at Large Rental Associate within a timely manner.Each day a rental is late, Bananas will charge you 100% of the original rental cost. On the third day, you will be charged a$250 service fee in addition to the late fees. If the rental is not returned within 4 days after it is due, you will be charged all ofthe late fees, and retail replacement price of all of the equipment.DELIVERY & PICKUP: If scheduled in advance, Bananas at Large will deliver and pickup your rental order for you. Adelivery and pickup fee will apply and will vary with size of rental, on-site challenges, and distance traveled.Bananas At Large assumes a trained and competent audio, lighting and/or video professional will be operating our equipmentduring the rental period. We can provide engineering and/or set up take down services if needed.ENGINEERS & TECHNICIANS: As a free service to our Rental Customers, we are available as consultants to answerquestions, offer suggestions, and assist you in pre-planning your event and achieving your goals. However, in depth producttraining, on-site audio engineers, technicians, and additional labor can be reserved and will be billed according to number ofpeople needed and level of expertise. Any on-site labor or technical support must be reserved in advance.We are happy to answer basic questions, and show you the basic steps of using your rental equipment. If you do not know howthe equipment works, and you want us to fully train you to use the equipment, we can do it here, and we charge $75 per hour,with a minimum of one hour. House calls for training are a minimum of $150 for the first hour, and $75 per hour thereafter.Deliveries/Set-ups/Pick-Ups are a minimum of $100 each, and do not include training or tech support. If you need us toengineer your rental, we charge $100 per hour, with a minimum of 2 hours.ACCESSORIES: Your rental order will be accessorized with the appropriate cable, cords, microphone clips, speaker stands,and adaptors. All accessories are due back with the rental return in working order. Return orders missing accessories will becharged the replacement costs for those items not returned. There will also be a replacement cost charged for accessoriesreturned broken or dysfunctional due to abuse or neglect.CANCELLATIONS & LATE FEES: Any cancellations of rental orders must be made 48 hours (2 business days) in advanceof the order being picked up or delivered. You are responsible for the loss of use and you shall fully compensateus for the loss of use of the Equipment during the time that it is being repaired or replaced, as applicable.Valuation of Loss/Our Liability is Limited:Unless otherwise agreed in writing, you shall be responsible to us for the replacement cost value or repair cost of theEquipment (if the Equipment can be restored, by repair, to its pre-loss condition) whichever is less. If there is a reason tobelieve a theft has occurred, you shall file a police report. Loss of use shall be calculated at the rental rate provided for in thisagreement. Accrued rental charges shall not be applied against the purchase price or cost of repair of the lost, stolen ordamaged Equipment. In the event of loss for which we are responsible, our liability will be limited to the contract price andWE WILL, IN NO EVENT, BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, OR INCIDENTAL DAMAGES.Customer Initial: ___________CONDITION OF EQUIPMENT: Customer will assume all obligation and liability with respect to the possession ofEquipment, and for its use, condition and storage during the term of this agreement except as otherwise set forth herein. Youwill, at your own expense, maintain the Equipment in good mechanical condition and operating order. The rent on any of theEquipment will not be prorated or abated while the Equipment is being services or repaired for any reason which you areliable. We will not be under any liability or obligation in any manner to provide service, maintenance, repairs, or parts for theEquipment, except as otherwise specially agreed or as may be within the course and scope of employment by you. Allinstallations, replacements, and substitutions of parts or accessories with respect to any of the Equipment will become part ofthe Equipment and will be owned by us.We guarantee our equipment 100%. All equipment is thoroughly examined and quality tested prior to and directly after eachrental to ensure that your event is successful and free of unexpected problems.All problems with equipment must be reported immediately to Bananas at Large to be considered for adjustment.We do our best to make sure that rentals go out tested, and in working order. If anything malfunctions, we will test it forreview upon return, sending it out to an outside source if necessary, and determine what the error was. If it is determined thatthe equipment failed due to a manufacturers defect or normal wear and tear, we will not charge you for that particular item, orany items requiring the equipment in question to operate. If the equipment fails due to, but not limited to: usage by a non-trained audio professional, user error, miss-use, dropping, hitting, burning, excessive heat, sand, spilling water or other liquidson, bad power, power surges, excessive stress, pulling chords, incorrect handling, overloading, cross wiring, custom wiring, badfuses, bad circuit breakers, or basic inexperience, the rental will not be refunded. Any equipment that needs to be repaired orreplaced you will be charged parts, labor and a service fee to repair or replace the items.Bananas at Large takes every precaution to prevent field failure, however, things do happen - especially with electronicequipment. We rotate our inventory to take advantage of the newest AV gear, and test each rental just before pickup ordelivery. If the equipment does malfunction, our first priority is always given to day-of-event equipment failures (althoughthese are extremely rare). When required, a replacement unit or service technician will be dispatched as soon as possible. Ifproduct is not defective delivery fees and additional rental costs will be applied.All Rentals are for local Bay Area only. No rentals may leave a 50 mile radius without prior consent. No rentals may be takento dessert or sand locations.RENTALS CANCELLATION POLICY:Due to the fact that all of our equipment is by reservation only, and your requested equipment is removed from our availableequipment list. We are forced to charge a Cancellation Fee to compensate for the time the equipment is not available, asfollows:- Day Of Event Cancellation - 75% of the total rental invoice_- Less Than 48 Hours Notice up to day of event - 50% of thetotal rental invoice_- More Than 48 Hours - $25 Cancellation FeeIf you need to cancel, please let us know AS SOON AS POSSIBLE.CABLE WRAP FEE: All unwrapped cables are subject to a $0.25/foot cable wrap fee.Some rental items are available for purchase and all items in our rental department may be purchased brand new at our store. If youwish to purchase used rental equipment, it may not be available right away. Do not assume that you can keep a rental extra daysbecause you plan to purchase the equipment. You will be charged all of the late fees, since we most likely have the item in questionreserved for another customer. If you decide to purchase new equipment based on your rental, you can apply 25% of your rental cost ofthe equipment you want to purchase towards the purchase of it new for a period of 14 days after the rental is returned.
